1. ACKNOWLEDGEMENT OF RISKS: I, the undersigned, acknowledge that operating a golf kart involves inherent risks, including but not limited to the risk of injury or death to myself and others, and damage to property. I understand these risks and voluntarily choose to rent and operate a golf kart.
2. RELEASE & WAIVER: In consideration of being permitted to rent and operate a golf kart, I hereby release, waive, discharge, and covenant not to sue [Kool Kart Rentals OIB], its owners, employees, agents, and affiliates (collectively referred to as "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any third party, or to any property belonging to me or any third party, while operating or in connection with the operation of the golf kart.
3. INDEMNIFICATION: I agree to indemnify and hold harmless the Releasees from and against any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of or related to my use of the golf kart.
4. RULES & REGULATIONS: I agree to comply with all local laws and regulations governing the operation of the golf cart. I understand that I am responsible for any citations or fines incurred during the rental period. I also agree to follow any additional rules and guidelines provided by [Kool Kart Rentals OIB].
5. CONDITION OF GOLF KART: I acknowledge that I have inspected the golf kart prior to use and found it to be in good operating condition. I agree to return the golf kart in the same condition in which it was received, barring normal wear and tear. I am responsible for any damage to the golf kart that occurs during my rental period.
6. AGE & LICENSING: I affirm that I am at least 18 years of age, as well as all other drivers that will be operating the golf kart, and we all possess a valid driver's license. We agree to present our driver's licenses upon request by [Kool Kart Rentals OIB].
7. NO ALCOHOL OR DRUGS: I agree not to operate the golf kart while under the influence of alcohol, drugs, or any other substance that may impair my ability to safely operate the vehicle.
8. CHARGING THE GOLF KARTS: Please only charge golf karts directly in an outlet/receptacle and charge after each use, no extension cords. DO NOT let the golf kart battery get below 40%. NEVER leave the key in the golf kart.
9. LIFTED KARTS: Do not make turns at high speeds, as they are prone to rollover at high speeds.
10. GOLF KART KEY: You will be provided one (1) key for your rented golf kart. The key must be removed from the golf kart anytime that it is left unattended. Loss or theft of the golf kart key will result in a replacement fee being charged. (Replacement fee ranging from $50-$275, depending on the golf cart brand).
11. CANCELLATION POLICY: You may cancel up to 30 days before your arrival date, in order to receive full reservation fee.
12. BINDING AGREEMENT: I understand that this waiver and release of liability is binding upon me, me heirs, executors, administrators, and assigns. I HAVE READ THIS WAIVER AND RELEASE, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
